TERMS OF SERVICE

 

Diversity of Nursing Excellence, LLC is an academic consulting and tutoring firm. Although we strive to maximize the student capacities and empower you to achieve excellence in your academic and professional development, we cannot guarantee results and outcomes unless otherwise clearly stated for a specific service. It is noted all final decisions regarding grades and; applications, are made by external, non-affiliate organizations. Our primary objective is to provide you with the essential tool kit necessary to give you a competitive edge. We cannot take tests on your behalf, guarantee test scores, or admission decisions. It is the responsibility of the applicant to follow the specific instructions, policies and guidelines of their school in order to ensure compliance with their program of choice. Additionally, Diversity of Nursing Excellence LLC operates in an ethical manner and all data presented is obtained through publicly available sources. Importantly, note that Diversity of Nursing Excellence LLC is not affiliated with, nor endorses, any of the organizations mentioned including, but not limited to universities, colleges, official test administrators or any external websites, unless otherwise explicitly indicated.

Services for the packages are valid for one application cycle. All services are offered via phone, email and webcam and in special circumstances with pre-approval in person.

 

Diversity of Nursing Excellence LLC (referred to as “DONE” or “us” or “we”), provides tutoring online as well as certain services (collectively referred to as “Services”), subject to your compliance with the following Terms and Conditions of Use (“Terms”), as well as any other written agreement(s) between us and you.

By purchasing Diversity of Nursing Excellence LLC services, I agree to the terms of this Agreement:

Availability of our Tutors

DONE shall have discretion in selecting the dates and times it performs tutoring services.  We will do our best to accommodate the client’s needs regarding date and time, but ultimately all scheduling is dependent upon the availability of the Tutor.  Client acknowledges our tutors are all full-time practicing educators and nurses. Occasionally emergencies arise and the tutor may be delayed or must reschedule. If DONE client requires more services at any time, DONE is not obligated to undertake such work. In-person meetings can be scheduled on a case-by-case situation when requested by the client.

Cancellations

Regarding cancellations and/or rescheduling, you must provide us with at least 24 hours’ notice. With respect to tutoring sessions, if you cancel/reschedule less than 8 hours before your appointed time slot or you will be considered a “no-show”, this can result in loss of that specific service without any obligation by DONE to reschedule.  In the case of missed appointments this can result in loss of that specific service without any obligation by DONE to reschedule.  This will also depend upon the plan scheduled with us.

 

 

Tutoring Services

I acknowledge when working on assignments, Diversity of Nursing Excellence LLC and its tutors will not write assignments for me. DONE provides guidance in study skills, time management, organizational skills, self-care strategies, and success planning through engagement and feedback. I certify that all assignments, such as the personal statement, supplemental essays required from applicants, and descriptions of work/activities, are my own and have not been written, in part or in whole, by a third party.

If you are receiving advice outside of Diversity of Nursing Excellence LLC and its tutors on your personal goals and objectives, we are not responsible for information and content gained from an outside source, and we will not discourage nor will we support students from seeking knowledge from an outside source.

Payment/Refunds

Payment is due upon signing up for services. Fees are subject to change at any time.  Services paid for are valid for the application cycle for which they were purchased. No refunds are given for unused services. The client has one-year to use the services.

Refunds cannot be issued for services already rendered in any circumstance.

 

Confidentiality

 All communications between DONE and client are strictly confidential. At no time will your name or work be released beyond our advisors. At DONE we take every step to secure your privacy and confidentiality. Any and all information gathered from you throughout our tutoring sessions will be held in confidence, not shared with a third party (i.e. individual, group, corporation, etc.), or used as data in a study, without your written and signed consent. Although your privacy is our highest priority, DONE cannot guarantee the security of all electronic communications via the internet, as online communication is not always one hundred percent secure and, in the unlikely event of lost or stolen information over the internet, DONE will not be held responsible.  All advice given to client (to include all written, verbal and video communication) is for his or her exclusive use only and shall not be shared with anyone else or published online under any circumstances.

No Guarantee

I acknowledge there is no guarantee that the services provided by DONE will guarantee my chances to matriculate or pass the NCLEX. However, every effort is made to support student success with the help of DONE’s tutors.

Termination of Services

Either party may terminate this relationship at any time for any reason by giving written notice to the other party. Upon termination, no refunds can be issued.

My Responsibilities

The student is solely responsible for his/her own learning and workload in its entirety, including the submission, meeting of deadlines, and communicating with the tutor their needs.

 

Recording of Sessions

I acknowledge that DONE will not record any sessions as part of its services and that I may not record any sessions or recordings without the express permission of DONE. I agree that I shall not distribute any such recordings of session or otherwise use same for any purpose, except as agreed to by DONE. I further agree that I shall not record any sessions under any circumstances.

Further Agreements

By purchasing DONE’s services I agree to the following: I release DONE, including its associated employees, consultants, tutors and contractors (all of whom shall be referred to as “DONE Tutoring”) and discharge DONE all claims, demands, or actions by me, on the basis of the discussions and interpretations of DONE. Consideration for this release and disclaimer of liability on behalf of DONE, shall be the services rendered by DONE.

Each service requires full pre-payment. DONE reserves the right to terminate a relationship with a client for any reason and at the sole discretion of DONE. If a refund is issued, this amount will be determined at the sole discretion of DONE at the time of termination. All services must be used within twelve months of purchase unless otherwise specified by DONE. Funds used to purchase a specific service cannot be used towards the purchase of a different service. No refunds will be issued for unused services. Advice provided by DONE is the intellectual property of DONE. Services are not transferable. All consultations must take place between the tutor and the client. Parents and significant others may not participate in discussions between the tutors and the client. Guidance will not be offered directly to parents, significant others, or client sponsors. By purchasing DONE services, I agree with the aforementioned under any applicable law or regulation.

Non-disparagement

For purposes of this Section, “disparage” shall mean any negative statements, reviews, comments, or feedback, whether written or oral, about DONE. This will include all written or electronic communication, whether email, text message, use of Yelp, LinkedIn, Facebook, etc. Client agrees to take no action which is intended, or would reasonably be expected, to harm the Company or its reputation which could reasonably be expected to lead to unwanted or unfavorable publicity for Diversity of Nursing Excellence LLC Online or DONE.

All disputes, controversies, or claims arising out of or relating to this contract shall be submitted to binding arbitration in accordance with the applicable rules of the American Arbitration Association then in effect.

In the event of litigation relating to the subject matter of this Agreement, the non-prevailing party shall reimburse the prevailing party for all reasonable attorney fees and costs resulting therefrom.
